Legal Descriptions

Real estate licensees must be extremely careful when inserting legal descriptions into contracts. Even small mistakes, including punctuation errors, can cause serious title problems. While errors can sometimes be corrected before closing, mistakes may delay the transaction, cause the licensee to lose a commission, or even result in legal liability. To avoid these issues, real estate professionals should always copy the legal description from a reliable source, such as the current deed or the county property appraiser’s or tax roll website.There are three types of legal descriptions used today: (1) metes-and-bounds(2) government survey system(3) lot and block descriptions.
