Non-Residential Transactions (Commercial): If you are selling a warehouse, an office building, or a 50-unit apartment complex, you don't need to give the buyer or seller a disclosure form, because the law assumes these are savvy business people who have lawyers and don't need a basic explanation of what a real estate agent is.Rentals or Leasing: If you are just helping someone rent an apartment for a year, you don't need to provide relationship disclosures. A lease is temporary, and the financial stakes are much lower than buying a house.The Big Exception: There is one time you do need it for a rental: Lease Options (Rent-to-Own). If you write a lease for a house (4 units or fewer) that gives the tenant the option to purchase it later, you must provide the disclosure. Because it might turn into a sale, the residential sale rules apply.
