This statute explains why the government is allowed to create rules for your job. The bottom line? They only step in when they have to.1. The Main Goal: Safety, Not Exclusivity Everyone has a right to work. The state only regulates professions (like real estate) to protect the public's health, safety, and welfare. They are not allowed to create rules just to make the profession "exclusive" or to limit competition so that current agents can make more money.2. The Checklist: When Can They Regulate? The state can't just regulate without a reason. They can only pass these laws if: It’s Dangerous: Leaving the profession unregulated would actually harm the public. The Danger is Real: The risk isn't just a "what if"—it's a recognizable threat.It’s Worth It: The safety benefit outweighs the hassle of restricting who can do the job. No Other Fixes: There aren't already federal or local laws fixing the problem.3. DBPR or FREC makes rules that don’t go overboard. They have to play fair:Keep it Reasonable: They can't make getting a license impossibly hard for qualified people. Keep Costs Low: They shouldn't make licensure expensive if they don't have to. Don't Kill Jobs: Regulations shouldn't destroy job opportunities unnecessarily.
