Real-estate commissions are negotiable; there is no legally required industry-wide percentage. A brokerage can explain the price it is willing to charge, but that offer is not the same as a rate imposed by law.
The National Association of Realtors' negotiation guide explains that consumers can discuss services and compensation before signing. Negotiable does not mean either side must accept the other's proposal. You can compare offers, ask questions or decide that an agreement is not suitable.
Compare the actual package rather than only a percentage. What work is included? When is payment earned? Is there a cancellation provision? Could compensation remain payable after the agreement ends? If you are a buyer, ask how a seller's contribution would affect your own payment obligation under the agreement.
Here is a simple calculation, not a recommended rate: 2% of a $300,000 purchase price is $6,000. A separate offer might use a $5,000 flat fee. The lower number does not tell you whether the services, conditions and payment triggers are the same. Read both proposals before comparing them.
Florida Realtors' buyer-agreement guidance also distinguishes a specific compensation arrangement from an open-ended promise to accept whatever a seller offers. Do not assume the seller must pay the buyer's brokerage or that a seller's offer automatically changes your signed agreement.
For the course connection, review our brokerage relationships study guide. Keep the key distinction clear: an agreed fee can be binding under a contract even though no law set that fee in the first place.
