If a small owner-occupied property or a private single-family sale meets a federal Fair Housing Act exemption, does that also exempt its advertisements?

No blanket advertising exemption comes with the federal small-owner exemptions. The limited exemptions in 42 U.S.C. section 3603(b) expressly leave the advertising provision in section 3604(c) in place.

That distinction matters for certain qualifying private single-family transactions and owner-occupied properties with no more than four independent family units. Those categories have conditions; merely calling a property small or privately owned does not establish an exemption.

Section 3604(c) addresses housing notices, statements, and advertisements indicating a preference, limitation, or discrimination based on protected characteristics. The federal list includes race, color, religion, sex, disability, familial status, and national origin.

Imagine an owner who lives in one unit of a duplex and advertises the other separate apartment. The owner should not assume that living on the premises permits an advertisement excluding applicants simply because they have children. A possible exemption affecting one part of the Act does not erase the advertising provision.

For a practical writing check, describe the property and legitimate terms: its layout, rent, location, parking, and application process. Compare a factual description such as "two-bedroom apartment with covered parking" with wording that selects the kind of person the owner wants. The second approach requires careful fair-housing scrutiny.

This is not a complete review of every federal exemption. Qualifying housing for older persons, other laws, and specific facts can raise separate questions. State and local protections may also apply. Obtain qualified advice before relying on an exemption in an actual transaction.

Read the federal exemption language alongside the advertising rule, not instead of it. Our fair housing study guide provides additional context for reviewing advertisements and rental practices.
