Section 14 of 29
One of the most critical sections of the real estate application is the background disclosure. The Florida Department of Business and Professional Regulation (DBPR) requires all applicants to be honest, trustworthy, and of good moral character.Honesty is Mandatory: You must disclose ALL criminal convictions, regardless of how long ago they occurred. This includes felonies, misdemeanors, and traffic offenses that resulted in fines of $500 or more.What to Disclose: You must report if you have ever been convicted, found guilty, or entered a plea of nolo contendere (no contest) or guilty, even if adjudication was withheld (meaning you were not technically "convicted" by the court).Sealed or Expunged Records: In many cases, you must disclose these as well. While some specific expunged records might be exempt, it is generally safer to disclose everything to avoid being denied for "failure to disclose".
