Brokerage Business brokerage is the activity of buying and selling existing businesses. While it sounds distinct from selling homes, it is legally treated as a branch of real estate practice. This is because almost every business sale involves real property in some form: either the assignment of a long-term lease (for a shop in a mall) or the actual sale of the land and building where the business operates. Because an interest in real property is changing hands, Florida law (specifically Part I of Chapter 475, F.S.) requires individuals who broker these deals to hold a valid real estate license. A standard real estate licensee is legally permitted to sell businesses, although it requires specialized knowledge.
