Judicial Review (The Appeal)

If you lose at the FREC level, you have the right to appeal to a real court - The District Court of Appeals. You must file the appeal within 30 days of the Final Order.Can I keep working while I appeal? Stay of Enforcement: Simply filing an appeal does not stop the punishment. If your license was revoked, you are out of business immediately unless you ask for a "Stay of Enforcement" (a pause button).Writ of Supersedeas: This is the legal document the court issues to grant that stay. Definition: A Writ of Supersedeas pauses the suspension/revocation, allowing you to continue practicing real estate until the appeal is decided.Condition: The court will usually grant this unless the FREC proves that letting you keep working would be a danger to the public.
