Based on Florida Real Estate Law (Chapter 475, F.S.) here are the key rights of an applicant:Right to Review the Exam: If you fail the state exam, you have the right to review your exam within 21 days of the date of the examination. You can see the questions you missed and the correct answers. (Note: Reviewing the exam may delay your ability to schedule a retake immediately due to the appeals window.)Right to a Hearing: If your application is denied, you have the right to request a formal or informal hearing to appeal the decision.You must file a written objection within 21 days of receiving the Notice of Intent to Deny.Right to Legal Counsel: You are entitled to be represented by an attorney during any hearing or appeal process, though it is not required.Right to Apply: Anyone who meets the basic requirements (age, education, etc.) has the right to submit an application. The FREC cannot deny an application based on race, color, religion, sex, national origin, handicap, or marital status.
