Transfer by Involuntary Alienation. As the name suggests, this is when property is transferred without the owner's control or consent. It usually happens because of a legal process. While there are several types (like foreclosure or eminent domain), today we are focusing on what happens when someone dies without a plan.Transfer by Descent (The "No Will" Rule)"The State Writes Your Will for You"If you die and leave a valid Will, you are "Testate," and you chose your heirs (Voluntary).But if you die without a Will, you have died Intestate.When this happens, you have lost your voice. You no longer get to say, "I want my house to go to my favorite nephew." Instead, the State of Florida steps in and transfers your property according to the Laws of Descent and Distribution.
