The Final Order (The Decision)

Now the case goes back to the FREC for the final decision. This happens at a regular Commission meeting. Who gets to vote? (The Exclusion Rule). The two members of the FREC who served on the Probable-Cause Panel are excused from the room. They have already seen the evidence and decided to charge you. They are "biased." To ensure you get a fair trial, only the other FREC members who haven't seen the case yet get to vote on your guilt and punishment.The Final Decision - The remaining FREC members read the ALJ’s Recommended Order. They can accept it, reject it, or modify the penalty (make it harsher or lighter). They issue the Final Order. This is the official legal document that suspends, revokes, or fines you. It becomes effective 30 days after it is filed.Emergency Action: Summary Suspension - Sometimes, a broker is so dangerous that the state cannot wait months for a trial (e.g., a broker is emptying the escrow account and booking a flight to another country). The Action: The DBPR Secretary (not the FREC) can issue a Summary (Emergency) Suspension Order.Effect: Your license is suspended immediately to protect the public while the investigation continues.
