Adverse Possession "Squatter's Rights". This is the most controversial form of involuntary alienation. It allows a stranger to legally steal your title if they occupy your land long enough and you do nothing about it.To claim adverse possession in Florida, the squatter must prove their possession was:Hostile: Without the owner's permission.Open: Visible to everyone (not hiding in a basement).Taxes: Crucial in Florida! The adverse possessor must pay the property taxes on the land during the possession period.Claim of Title: They must act like they own it (maintaining it, improving it).Adverse: Against the true owner's interests.Notorious: So widely known that people think they are the owner.
