Whether you die with a will (Testate) or without one (Intestate), the property must go through a legal process called Probate.The court freezes the assets, pays off the debts, and then distributes what is left to the legal heirs.Many students confuse "Devisee" and "Heir."If you see the word "Heir," assume there was NO Will (Intestate).If you see the word "Devisee," assume there WAS a Will (Testate).
