Income Property Foreclosure:When an apartment building or strip mall goes into foreclosure, it’s complicated because there is rental income involved.If a landlord stops paying the mortgage, they might still be collecting rent from tenants and pocketing the cash while the foreclosure drags on for months.The mortgage includes a Receivership Clause.The court appoints a neutral third party (a Receiver) to manage the property. The Receiver collects the rent, pays the bills (water, electric), and maintains the building. The landlord is cut out of the loop immediately to preserve the asset's value.
