Step 1 of Disciplinary Procedure is The Complaint agains a licensee. It all starts when someone files a complaint. This could be a disgruntled buyer, a seller, another broker, or even the DBPR itself.The complaint is filed with the DBPR (Department of Business and Professional Regulation). The DBPR doesn't investigate everything. If a buyer complains that "The agent was rude and wore an ugly tie," the DBPR will ignore it. To be investigated, a complaint must be Legally Sufficient. This means that if the facts are true, they would violate a Florida statute or FREC rule.For a first-time offense of a minor violation (one that doesn't endanger the public or involve money), the DBPR might just issue a Notice of Noncompliance. You have 15 days to fix the problem. If you fix it, no disciplinary action is taken.
