Disclosures are not required for auctions. Auctions are fast-paced and public. The auctioneer doesn't stop the bidding to hand out relationship paperwork to everyone in the crowd. The specific disclosure rules are waived here because the nature of an auction makes them impractical.Appraisals: An appraiser is hired to give an opinion on price, not to help negotiate a deal. Since they aren't acting as an agent trying to buy or sell the property, they don't need to disclose an agency relationship.Business Enterprises: Sometimes, you might sell a business itself—like a restaurant operation or a dry cleaning business—rather than just the land. This is considered a "business opportunity" sale. Even if real estate is involved, the strict residential disclosure rules generally don't apply to the sale of the business entity.
