A local government adopts a building-safety requirement, then separately acquires a strip of private land for a road. Which action illustrates police power and which illustrates eminent domain? Explain why a drop in property value does not, by itself, settle the distinction.

A lawful building-safety regulation is an exercise of police power; compulsory acquisition for the road illustrates eminent domain. Start by asking whether government is regulating how property may be used or acquiring a property interest for a public purpose.

Police power supports regulation for public health, safety and welfare, subject to legal limits. Florida's Attorney General discusses that regulatory foundation and its limits in an opinion on zoning authority. Eminent domain concerns taking private property; Article X, section 6 of the Florida Constitution requires a public purpose and full compensation.

Worked example: A town requires compliant fire exits when an owner remodels a small office. The owner retains the land and building, but the project must satisfy the safety rule. That is the regulatory side of the comparison. In a separate project, the town needs a 12-foot strip along the lot for a public road widening and uses condemnation to acquire it. That is the acquisition side. The public objective alone does not distinguish them: both actions may serve the public.

Pitfall: Do not use the shortcut that any expensive regulation is eminent domain, or the opposite shortcut that regulation can never require compensation. Regulatory-takings questions can arise without an ordinary purchase or physical seizure. Whether a particular restriction crosses that legal boundary is a separate, fact-intensive inquiry.

For a straightforward exam scenario, underline the operative verb: requires, limits or regulates points toward police power; takes or acquires through condemnation points toward eminent domain. Then read for facts that make the simple classification insufficient.
