Property Rights
Section 18 of 28
Tenancy by the Entireties. This is a special form of ownership reserved exclusively for married couples. The law views the couple not as two people (50/50), but as one single legal unit (100% + 100%).Right of Survivorship: If one spouse dies, the other automatically owns the property in severalty. No probate needed.Protection: Creditors of one spouse cannot seize the house to pay debts (unless the debt is in both names). If the couple divorces, the "unity" is broken. They automatically become Tenants in Common (50/50 owners).
