A telephone solicitation is a telephone call placed for the purpose of encouraging the purchase of, or investment in, property goods, or services. Cold calling (telemarketing) is heavily regulated to protect people's privacy.Hours: You can only call between 8:00 AM and 9:00 PM.Do Not Call Lists: You must check the "Federal Do Not Call List" and the "Florida Do Not Call List."The Fines: Florida takes this seriously. The fine for calling someone on the Florida Do Not Call list can be up to $10,000 per call. The Federal fine is even higher (over $40,000).The Exception: If you have a legitimate, existing business relationship with a client (or they called you first), you can call them even if they are on the list (for up to 18 months after a transaction).Email (CAN-SPAM Act): You can send marketing emails, but you must give people a way to opt-out (unsubscribe). You must include a valid physical postal address in the email. You cannot use deceptive subject lines (e.g., "Urgent! About your mom..." when it's just a sales pitch).
