For a deed to hold up in court, it must meet these criteria:In Writing: (Statute of Frauds). No handshake deals for land.Names: Grantor and Grantee must be identified.Grantor Competence: The Grantor must be of legal age and sound mind. (A deed signed by a minor is voidable).Consideration: Must be stated (even if it's just "$10").Granting Clause: Must clearly say "I am giving this to you."Habendum Clause: Must define the estate.Legal Description: Must accurately identify the land.Signatures (Crucial): Signed by the Grantor. Witnessed by two people (in Florida). Note: The Grantee does NOT need to sign.Delivery and Acceptance: Title does not pass until the deed is voluntarily delivered and accepted.
