Penalties Issued by a Court of Law (Criminal)

The FREC can only take your license and fine you. They cannot send you to jail. Only a court can do that. You need to memorize the specific crimes for the exam.Second-Degree Misdemeanor - The Crime: Breaking most rules in Chapter 475 (e.g., false advertising). The Punishment: Up to 60 days in jail and/or $500 fine.First-Degree Misdemeanor - The Crime: There is only ONE first-degree misdemeanor you need to know: Failing to provide accurate and current rental information for a fee. (If you sell a fake rental list to a tenant). The Punishment: Up to 1 year in jail and/or $1,000 fine. (Remember: 1st Degree = 1 Year)Third-Degree Felony - The Crime: These are the most serious violations. Unlicensed Activity: Practicing real estate without a license.Falsifying an Application: Lying on your DBPR application.Theft of Exam: Stealing questions or reproducing the state exam.The Punishment: Up to 5 years in prison and/or $5,000 fine.
