The 55+ Rule (The Most Common). The Requirement: At least 80% of the occupied units must have at least one person who is 55 years of age or older.The Policy: The community must publish and adhere to policies that demonstrate an intent to be housing for older persons. If they meet this 80% threshold, they are exempt from the Familial Status protection. This exemption only allows them to discriminate based on Familial Status (kids). It does NOT allow them to discriminate based on Race, Religion, or Handicap. A 55+ community cannot say "No Asian Seniors allowed."The 62+ Rule - 100% of the residents must be 62 years of age or older. If it is strictly a retirement home for people 62+, they can legally refuse families with children.
